First edition, second issue, with correct spelling of “Asserted” in the title. A few years before
founding Pennsylvania, William Penn was a radical Quaker leader. In 1670, he and William
Mead were arrested for preaching to an illegal gathering in the street. They were not allowed to
present a defense. The judge ordered the jury to find the defendants guilty, and when they
refused, he had them imprisoned. Their appeal established the independence of juries in
England and America, making this an important trial even beyond Penn’s involvement. This
pamphlet includes the trial transcript, as well as the defense Penn and Mead had planned to
offer to the court “had they not violently over-rul’d and stopp’d them.” ESTC R479411;
